Welcome to Uraga Social (accessible at social.brandformance.id, referred to as the "Platform" or "App"), operated by Uraga.id ("Company", "we", "us", or "our"), a social media agency based in Indonesia. By accessing or using Uraga Social, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use Uraga Social.
"User" refers to any individual or entity that accesses or uses Uraga Social, including clients, visitors, and authorized third parties.
"Services" refers to the social media management, content creation, scheduling, analytics, campaign management, and related services provided through Uraga Social.
"Content" refers to any text, images, videos, graphics, data, or other materials uploaded, published, or shared through Uraga Social.
"Connected Platforms" refers to the third-party social media platforms integrated with Uraga Social, including but not limited to TikTok, X (formerly Twitter), Meta (Facebook, Instagram, and Threads), LinkedIn, and YouTube.
You must be at least 18 years of age or the age of majority in your jurisdiction to use Uraga Social. By using the App, you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms.
To access certain features of Uraga Social, you may be required to create an account or connect third-party social media accounts. You agree to provide accurate, current, and complete information during registration; maintain the security and confidentiality of your login credentials; notify us immediately of any unauthorized access or use of your Uraga Social account; and accept responsibility for all activities that occur under your account.
Uraga Social enables the management of social media accounts and content across Connected Platforms, including TikTok, X, Meta (Facebook, Instagram, and Threads), LinkedIn, and YouTube. By using our Services, you grant us the necessary permissions to access, manage, and publish content on your connected social media accounts; retrieve and analyze performance data, metrics, and analytics from your accounts; schedule and automate content posting on your behalf; and manage audience engagement, including responding to comments and messages as authorized.
Uraga Social integrates with Connected Platforms through their respective APIs. Your use of these integrations is also subject to the terms and policies of those third-party platforms, including but not limited to TikTok's Terms of Service, X's Terms of Service, Meta's Terms of Service, LinkedIn's User Agreement, and YouTube's Terms of Service (including Google's Privacy Policy).
We are not responsible for the actions, policies, or availability of any third-party services. You acknowledge that Connected Platforms may modify, restrict, or discontinue their API access at any time, which may affect the functionality of Uraga Social.
You agree not to use Uraga Social for any unlawful, fraudulent, or malicious purpose; upload or distribute content that infringes on intellectual property rights of others; attempt to gain unauthorized access to Uraga Social, other user accounts, or connected systems; use Uraga Social to distribute spam, malware, or harmful content; violate the terms of service of any Connected Platform; or reverse-engineer, decompile, or disassemble any part of Uraga Social.
All intellectual property rights in Uraga Social, including but not limited to its design, features, functionality, trademarks, and proprietary technology, are owned by or licensed to the Company. Nothing in these Terms grants you any right, title, or interest in our intellectual property.
You retain ownership of the Content you upload or create through Uraga Social. By using our Services, you grant us a limited, non-exclusive license to use, reproduce, and distribute your Content solely for the purpose of providing the Services.
Your use of Uraga Social is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using Uraga Social, you consent to the practices described in our Privacy Policy.
Uraga Social and its Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that Uraga Social will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees regarding the results or outcomes of any social media campaigns, content performance, or audience growth achieved through the use of our Services.
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Uraga Social, including but not limited to loss of profits, data, business opportunities, or goodwill. Our total liability to you for any claims arising from or related to these Terms or the use of Uraga Social shall not exceed the total amount paid by you to the Company in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of Uraga Social, your violation of these Terms, or your infringement of any third-party rights.
We reserve the right to suspend or terminate your access to Uraga Social at any time, with or without cause and with or without notice. Upon termination, your right to use Uraga Social will immediately cease. You may terminate your account at any time by contacting us. Upon termination, we will revoke access to your connected social media accounts and cease all management activities.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be resolved through the courts of competent jurisdiction in Indonesia.
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on Uraga Social. Your continued use of Uraga Social after any modifications constitutes your acceptance of the revised Terms.
